This course is designed to guide the licensee in understanding the new requirements under The Dodd Frank Act which includes the new law (regarding RESPA and Truth in Lending) and new forms such as The Loan Estimate (formerly the Good Faith Estimate) regarding disclosing lending costs to the borrower and regarding settlement, including a new settlement statement (Closing Disclosure).

As the course caption states, “You do not have to be guilty to get sued”, is true! It is possible for an unintentional act to be perceived as a direct affront by the other party. It is also possible that an act by a client could implicate the licensee merely through association. And, although the licensee is found not guilty, the emotional and possible financial results can be substantial.  The course focuses on preventive measure topics structured to assist in protecting clients and in turn the real estate licensee.

This new course provides a general introduction to Oahu residential land uses and standards, optional developments and uses; and nonconforming residential lots, structures and uses. Included also is a case study, “Ohana Dwellings: A Good Intention Destined to Fail”, and the evolvement of additions/renovations/repair (AAR) units and additional dwellings units (ADUs) as alternatives to ohana dwellings.
