This course is designed to familiarize the licensee with what an agency is, what is involved regarding the duties and obligations of the licensee, and the applicability of agency. In most situations, the real estate licensee will be involved in an agency relationship (such as representation in a sales or property management situation), so the licensee should be aware of what he legally can or cannot do, what he can or cannot say, and the significance of ethics in an agency relationship. This course begins by defining agency and the Hawaii Revised Statues, the Hawaii Administrative Rules, and the National Association of Realtors Code of Ethics that apply to agency. Dual agency is also emphasized and the potential risks and problems that may arise from dual agency including safeguards for the brokerage. This course is designed to provide general knowledge, NOT legal advice to the licensee, such that the licensee is more familiar with the obligations of an agency in order to better assist their client in their transactions.
